JALANDHAR: 14th January 2012; A US Sikh resident, Resham Singh, who has been claiming that he had seen Congress leader Jagdish Tytler leading the mob of rioters during 1984 anti-Sikh riots has now approached a Delhi court through an affidavit requesting that his testimony about Tytler's role in the November 1984 killing of Sikhs be recorded before court gives its final verdict on the closure report filed by CBI.
In his affidavit sent to a Delhi court, Resham Singh has described the details of efforts carried out by him from 2008 till December 2011 to have CBI record his testimony regarding Tytler's involvement in the attack on Gurudwara Pul Bangash. In his affidavit he alleged that when the CBI team was in US to record the statements of witnesses (Surinder Singh and Jasbir Singh) in December 2008 he specially travelled from California to New York and waited outside the Indian Consulate in New York for four days and his presence was also told to the CBI team.
He alleged that despite his best efforts the CBI team did not record his statement even though its team was specifically in the US to record witnesses' statements about Tytler's role in the November 1984 killing of Sikhs.

Journalist Ritu Sarin exposed how CBI Chief Ashwani Kumar disregarded his own agency’s investigating officers’ report that Tytler should be booked for murder and rioting. According to records obtained by The Sunday Express, the Joint Director and DIG clearly recommended, in writing, that there was a strong case against Jagdish Tytler in the Bara Hindu Rao anti-Sikh violance case under a string of charges including murder, rioting and damage to property.
Despite the recommendation of CBI’s Investigating Officers’ to prosecute Tytler for his role in the killing of Sikhs, the CBI’s director Ashwani Kumar signed on the clean chit to Tytler. Arun Kumar, Joint Director of CBI in his written report recommending filing of murder charges against Tytler, stated that:
“Both important witnesses are presently in USA. If they are insisting on certain narration of facts, it will be difficult to ignore only by citing contradictions…Given the circumstances of these cases, it will not be appropriate to totally deny the present statements of Jasbir Singh and Surinder Singh regarding the incident. It will be appropriate to finally leave the decision in the hands of trial court. Hence, I tend to go with the opinion of the DIG and recommend prosecution of Jagdish Tytler under Sections 147, 149 and 109 IPC read with 302, 295, 427 and 436 IPC.”

This communication from December 2008 between attorney Pannun and SP Ratn Sanjay of CBI clearly shows that CBI did not record statements of additional witnesses against Tytler who were available in USA and thus CBI failed to properly investigate Tytler’s role in November 1984 killing of Sikhs. Witnesses Resham Singh and Jasbir Singh also submitted fresh affidavits to the court reaffirming their continued willingness to testify against Tytler.

Senior Congress leader Jagdish Tytler, the man who exhorted and led blood thirsty mobs in 1984 to kill and burn alive hundreds of Sikhs, and who has become the face of pogrom against the Sikhs, now cannot visit the United Kingdom.
Clearly, India’s ruling Congress party, its president Sonia Gandhi and rising Congress scion Rahul Gandhi too will get their own share of shame or embarrassment, depending upon their individual sensitization and sensitivity, as a result of the UK administration’s move. After all, they made Tytler chairman of the volunteers’ committee of the Commonwealth Games Organizing Committee, but just see what slap has London delivered.
Earlier Jagdish Tytler was given a clean chit by CBI as it could not collect the evidences in a period of 26 years against him as it works under pressure of ruling party of India and is not free.
Now the case is reopened on 24th July,2010, in the Court at Karkardooma, Delhi and next hearing is fixed on 21st August, 2010.
Chidambaram has declared on 14th December 2009 that NO FURTHER CASES AGAINST JAGDISH TYTLER. HE HAS BEEN GIVEN CLEAN CHIT BY GOVERNMENT OF INDIA.

Jagdish Tytler was the Indian Union Minister of State for Overseas Indian Affairs, a position he resigned from after an official commission of inquiry noted the 'balance of probability' indicated he was responsible for inciting and leading murderous mobs against the Sikh community in Delhi during the 1984 Anti-Sikh Pograms.
The official report of the Nanavati Commission of the Government of India found 'credible evidence' against Tytler, saying he 'very probably' had a hand in organizing the attacks. The Indian government, however, decided not to prosecute Jagdish Tytler due to lack of concrete evidence.
The Nanavati Commission report was 185 pages long. The commission submitted its final report in February 2004 detailing accusations and evidence against senior members of the Delhi wing of the then ruling Congress Party, including Jagdish Tytler, later a Cabinet Minister, MP Sajjan Kumar and late minister H.K.L. Bhagat. They were accused of instigating mobs to avenge the assassination of Indira Gandhi by killing Sikhs in their constituencies. On August 10, 2005, Jagdish Tytler was forced to resign from the Union Council of Ministers.
India's Central Bureau of Investigation (CBI) closed all cases against Jagdish Tytler in November 2007 for his alleged criminal conspiracy to engineer attacks against Sikhs in the aftermath of Indira Gandhi’s assassination on October 31, 1984. CBI submitted a report to the Delhi court which stated that no evidence or witness was found to corroborate the allegations against Tytler of leading murderous mobs during 1984.
It was also alleged in the court that then member of the Indian Parliament Jagdish Tytler was complaining to his supporters about relatively "small" number of sikhs killed in his parliamentary constituency Delhi Sadar, which in his opinion had undermined his position in the ruling Indian National Congress party of India.
The statements of the witnesses are also given to be examined by you all. I have just one request, your post should not consist any filthy or abusive language as he is an accused only. Moreover if he is found guilty, the Court will decide his future.

Because of my relationship with Gandhi family, because of my strong political position(probable CM candidate) and because the opposition wanted to damage my parties reputation by naming a person who can't be punished by law because there is no evidence or truth in it. Opposition always knew that congress will definitely punish the culprits so they name a man who has nothing to do with 1984 riots so that they can also victimize congress. But now, with the release of all the original documents, the truth will come up.

Why was I waiting for his last days? Was I waiting to see him on death bed and then offer him money? He gave his last statement when he him self knew that he is going to die. A religious person can never tell lies just before death. A religious person's conscience is greater then a temptation to money. A man about to die never thinks about money.My sincere request to all of you is that kindly read out all the documents and find the truth.
